These Terms of Service (“Terms”) govern your use of foundier.com (the “Site”) and your purchase of services from Foundier (“Foundier,” “we,” “us”). By using the Site, booking a call, or purchasing any service, you agree to these Terms.
1. Our services
Foundier provides AI search optimization and related services, including: the AI Visibility Audit; AI SEO Services; AI-Ready Website Design; Technical SEO + Schema; AI Visibility Monitoring; and Website Maintenance. Current scope and pricing for each service are described on the Site at the time of purchase, and the Site’s descriptions at the time you order form part of your agreement with us.
2. The AI Visibility Audit
2.1 Price and scope. The AI Visibility Audit costs $1,500 USD and includes the deliverables listed on the audit page at the time of booking.
2.2 Booking and payment. Booking a call reserves your slot. Payment of the audit invoice is what confirms the call and starts the delivery clock. If payment has not been received before the scheduled call, we may reschedule the call to a date after payment is received.
2.3 Delivery deadline and refund guarantee. Your audit report is due within five (5) business days of Day 1. “Day 1” is the day of your confirmed kickoff call following receipt of payment. If we fail to deliver the report within five business days of Day 1, you are entitled to a full refund of the audit fee. This guarantee does not apply where the delay results from your failure to provide access or information reasonably required (see Section 5), in which case the clock pauses until access is provided.
2.4 Audit credit. If you purchase any other Foundier service within sixty (60) days of receiving your audit report, the full $1,500 audit fee is credited against the price of that service. The credit applies once, is not transferable, and has no cash value.
3. Project services (AI SEO, Website Design, Technical SEO)
3.1 Project services are quoted at the prices and scopes published on the Site or agreed in writing before work begins. Timelines stated on the Site are good-faith estimates based on the scope described.
3.2 Work begins after payment terms agreed for the engagement are met. Where an engagement is delivered in phases, we will tell you the payment schedule before you commit.
4. Monthly services (AI Visibility Monitoring, Website Maintenance)
4.1 Monthly services are billed in advance at the rates published on the Site ($2,500/month for AI Visibility Monitoring, which includes website maintenance; $299/month for standalone Website Maintenance).
4.2 No minimum contract. You may cancel any monthly service effective at the end of the current billing month by emailing hello@foundier.com before your next billing date. We do not charge cancellation fees. Amounts already billed for the current month are not refunded.
5. Your responsibilities
You agree to provide, promptly and accurately: read-only or administrative access to your website as reasonably required; information requested in intake forms and during calls; and timely review or approval where a deliverable requires it. Delivery deadlines and guarantees are suspended for any period during which required access or information is outstanding.
6. Results disclaimer
Foundier optimizes the signals that AI engines and search engines use, and we measure our work with before-and-after testing. However, AI platforms (including ChatGPT, Perplexity, Claude, and Google AI Overviews) and search engines are operated by third parties, change without notice, and make their own decisions about what to display or cite. We therefore do not guarantee any specific ranking, citation, citation rate, traffic level, or revenue outcome. Statements on the Site about processes, timeframes, and typical patterns are descriptions of how we work, not promises of specific results.
7. Intellectual property
7.1 On full payment, you own the deliverables we create specifically for you (reports, content, designs, and code delivered as part of your engagement).
7.2 Foundier retains ownership of its methods, know-how, templates, tools, and any materials that existed before or were developed outside your engagement. We may use anonymized, non-identifying learnings from engagements to improve our services.
7.3 You confirm you have the rights needed to give us access to your website and materials, and that our authorized work on them does not infringe any third party’s rights.
8. Confidentiality
Each party will keep the other’s non-public information confidential and use it only for the engagement. This survives the end of any engagement. We will not name you as a client publicly without your permission.
9. Fees, taxes, and payment processing
Prices are in US dollars and exclude any taxes, duties, bank fees, or payment-processor fees applicable to you. Payments are processed by third-party providers (currently Payoneer); their terms apply to the payment transaction itself.
10. Limitation of liability
To the maximum extent permitted by law: (a) Foundier’s total liability arising out of or related to any engagement is limited to the amount you paid Foundier for that engagement in the six (6) months before the claim arose; and (b) Foundier is not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, lost data, or loss of business, even if advised of the possibility. Nothing in these Terms limits liability that cannot be limited by law.
11. Warranties disclaimer
Except as expressly stated in these Terms, services are provided “as is,” and we disclaim all other warranties, express or implied, including fitness for a particular purpose. Section 2.3’s refund guarantee is the exclusive remedy for late delivery of the audit.
12. Termination
Either party may end an engagement for material breach if the breach is not cured within fourteen (14) days of written notice. On termination, you pay for work performed up to the termination date; Section 2.3 (refund), Section 7 (IP), Section 8 (confidentiality), and Section 10 (liability) survive.
13. Changes to these Terms
We may update these Terms by posting a revised version with a new effective date. Changes apply to purchases made after the change; the Terms in force when you purchased govern that purchase.
14. Disputes
If a dispute arises, contact us first at hello@foundier.com and we will work with you in good faith to resolve it. Both parties agree to attempt informal resolution for at least thirty (30) days before pursuing any other remedy.
